Terms of Service
These Terms of Service ("Terms") are an agreement between you ("you", "your", or "Customer") and FG Enterprises LLC, doing business as Construct Pro ("we", "us", or "Construct Pro"), governing your use of the Construct Pro software and website (the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. The Service
Construct Pro is web-based software that helps construction contractors prepare quotes and estimates, manage customers, leads and projects, issue invoices, and track payments and job costs. The Service is provided on a subscription basis and is accessed through a web browser.
We may add, change or remove features over time. If we make a change that materially reduces core functionality you rely on, we will make reasonable efforts to notify you in advance.
2. Accounts and your team
- You must provide accurate information when creating an account and keep it up to date.
- You are responsible for keeping your password secure and for all activity under your account.
- The person who creates a company workspace is its owner and controls who may join it, and what each team member can see.
- You are responsible for the conduct of everyone you invite to your workspace.
- You must be at least 18 years old and able to enter into a binding contract.
3. Subscriptions, billing and cancellation
- Paid plans are billed monthly in advance at the price shown at the time you subscribe.
- Where a free trial is offered, you will not be charged until the trial ends. You may cancel before the trial ends at no cost.
- Subscriptions renew automatically each month until cancelled.
- You may cancel at any time from your account. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Except where required by law, payments already made are non-refundable, including for partial months. We may issue refunds at our discretion.
- Prices may change. We will give at least 30 days' notice before a price change affects you, and you may cancel before it takes effect.
- Applicable sales taxes are added where required.
- If a payment fails, we may suspend access after reasonable notice. We will not delete your data solely because a payment failed — see section 6.
Payment processing. Payments are processed by Stripe. We do not receive or store your full card details. Your use of payment processing is also subject to Stripe's terms.
4. Your data
Your business data belongs to you. Customer records, quotes, invoices, photos and any other content you enter remain yours. We claim no ownership of it.
You grant us a limited license to store, process, transmit and back up that content solely to provide and support the Service.
You are responsible for the accuracy and lawfulness of the data you enter, including having the right to store information about your own customers.
5. Acceptable use
You agree not to:
- Use the Service for anything unlawful, or to store unlawful content;
- Attempt to access another company's data, or probe, scan or test the security of the Service;
- Interfere with or disrupt the Service, or place unreasonable load on it;
- Resell, sublicense or white-label the Service without our written permission;
- Copy, reverse engineer or attempt to extract the source code of the Service.
We may suspend or terminate accounts that violate these rules.
6. Data export and deletion
- You may download a complete copy of your data at any time from within the Service, including after cancelling.
- After cancellation or termination, we retain your data for at least 30 days so you can export it, after which it may be permanently deleted.
- You may request deletion of your account and data at any time by contacting us.
7. Availability and support
We work to keep the Service available and reliable, but we do not guarantee uninterrupted or error-free operation. The Service may be unavailable during maintenance, or because of failures in services we depend on.
Support is provided by email at info@getconstructpro.com. We aim to respond within two business days.
8. Estimates, pricing data and professional judgement
Important. Construct Pro includes regional cost data and calculation tools to help you build estimates. These are aids, not professional advice. Actual material, labor and market costs vary. You are solely responsible for verifying every figure before relying on it, quoting a customer, or making a business decision. We are not liable for pricing errors, underbid jobs, lost profit, or tax or accounting outcomes arising from your use of the Service.
9. Third-party services
The Service relies on third parties including Google Firebase (authentication, database and file storage), Netlify (hosting), Stripe (payments), and mapping and geocoding providers. Their availability and terms are outside our control.
10. Intellectual property
The Service, including its software, design and branding, is owned by FG Enterprises LLC and protected by law. These Terms grant you a limited, non-exclusive, non-transferable right to use the Service while your subscription is active. All rights not expressly granted are reserved.
11. Disclaimer of warranties
The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, or non-infringement, to the fullest extent permitted by law.
12. Limitation of liability
To the fullest extent permitted by law, FG Enterprises LLC will not be liable for any indirect, incidental, special, consequential or punitive damages, or for lost profits, lost revenue, lost business or lost data, arising out of or relating to the Service.
Our total liability for any claim relating to the Service is limited to the amount you paid us in the twelve months before the event giving rise to the claim.
13. Indemnity
You agree to indemnify and hold harmless FG Enterprises LLC from claims, damages and expenses (including reasonable legal fees) arising from your use of the Service, your data, or your breach of these Terms.
14. Termination
You may stop using the Service and cancel at any time. We may suspend or terminate your access if you materially breach these Terms, if required by law, or if we discontinue the Service. If we discontinue the Service entirely, we will give reasonable notice and an opportunity to export your data.
15. Changes to these Terms
We may update these Terms. If we make material changes, we will notify you by email or within the Service before they take effect. Continuing to use the Service after that means you accept the updated Terms.
16. Governing law
These Terms are governed by the laws of the State of Texas, without regard to its conflict of laws rules. Any dispute will be brought in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction.
